Difficult mission of the Venice Commission

Gianni Buquicchio has left Tirana without any guarantee if the judiciary
reform will be consensual, but he gave a full guarantee that the Venice
Commission is ready to intermediate with the political forces for
making it possible.

“As I said, I have spoken to several representatives of political  parties. Dialogue, constructiveness, wide consulting and consensus were the key words in these meetings. Let’s make it clear that a wider consensus doesn’t mean unanimousness. When you go after unanimousness in democracy, you never reach any result. Democracy means free elections and the majority has the upper hand. But democracy doesn’t mean that the minority should not be respected. The divergences must be accepted, and find an understanding terrain within the possibilities. The role of the international community, especially that of the Venice Commission, is that the political parties can find an agreement for the interest of their country”, Buquicchio declared.

Although this European Council institution has been contacted by the Albanian authorities for assisting with their expertise in the legal reform, their main duty will be the negotiation between the political parties.

During this two-day visit in Tirana, Buquicchio has pressed on the high political division between the Albanian parties, which is unacceptable in a democracy that cannot be considered anymore young, as he called it. The Venice Commission expressed their readiness to assist with the legal reform in the decriminalization process, which will be implemented after the next general elections.

Gianni Buquicchio made it clear that the Venice Commission cannot assist every law of the Albanian Parliament, except for those with a constitutional character or of a very high sensibility.
