Council of Mandates, Doshi: “Withdraw the request, or else”

The Council for Regulation, Mandates Immunity met for reviewing the
authorization request of the Prosecution General for the arrest of
Parliament Members Tom Doshi and Mark Frroku. The meeting started with a
debate about the method how the meeting will be held.

Three members of the Democratic Party, Arben Ristani, Eduart Halimi and Kastriot Islami, supported by Tom Doshi, requested the presence of the media during the works.

“We must respect the tradition of hearing sessions. The media should be present for transparency. The regulation foresees that the hearing session is open”, declared the Democratic Party Parliament Members.

But the Prosecution’s representatives demanded a session behind closed doors, due to the investigation secrecy, as foreseen by article 103 of the Criminal Code.

The representatives of the majority requested a meeting for the Prosecution’s request, but the opposition and MP Doshi were against it.

After a few moments of debates, they finally decided for holding the meeting with the presence of the media.

In these conditions, the Prosecutors said that they could not make public the details of the investigation for as long that the media is present in the room. MP Doshi insisted to read the investigation case on which are based the three accusations against him.

“An arrest has been requested against me. There is no investigation secrecy today. Bring the evidence so that the Albanian can see if we will decide to go to the session or not”, Doshi declared, adding that every evidence is manipulated.

The Shkoder MP asked Prosecutors to withdrew their request, otherwise he would publish his entire conversation with Durim Bami, a detail that has been considered an investigation secret by the Prosecution of Serious Crimes.

Doshi’s lawyer then presented in front of the Council the stances of his client on why the accusations raised by the Prosecution do not stand.

“The Prosecutor’s request arrived without any further investigations on the case. We cannot breach the rights of the MP even if he is under investigation. The Prosecution has breached the Constitutional principle for equality in front of the law. The accusations against Doshi are politically motivated. The Prosecutors have the duty to show that their motivation is reason only. We also requested a parliamentary investigation if any other institution has intervened with the Prosecution”, the lawyer declared.

The Chairman of the National Security Commission, Spartak Braho, published what he called facts for a falsification of a medical document by Doshi.

“Tom Doshi presented a medical report given by Dr.Eduard Shota, whose wife works at the ’Profarms’. The Prosecution must investigate this”, Braho declared.
