Cefa continues judiciary battle

Six months ago, Elvis Cefa was discharged as Vice Chairman of the High
Council of Justice together with Lulzim Lelcaj, a HCJ member. Today he
insists to return as Chairman of the High Council of Justice.

Cefa and Lelcaj were discharged based on article 4 of the Constitutional Court, which had a verdict that repealed this law. The Administrative Court will now review both cases.

“The consequences will depend on the political stance of the majority. If the majority wants to return legality, then they have to allow us back. Otherwise, it will degenerate in huge financial costs, which doesn’t eliminate the violation of the Constitution for this case”, declared Ilir Cefa, former Vice Chairman of the HCJ.

While Cefa is waiting for the court verdict, it is unknown how it will be resolved beyond the judiciary aspect, since the Parliament has already appointed two other representatives at the HCJ, Albana Shtylla and Vangjel Kosta.

The post of the vice chairman of the HCJ has been empty for months, which passed his competences to the President, as Chairman of the HCJ.

“These members were elected by these majority. The Minister of Justice is pressuring the President unfairly to appoint the new vice Chairman of the HCJ. It is clear that the goal of the majority is to control the HCJ politically, and through it the entire judiciary”, Cefa declared.
