Court: “No power abuse for Fullani’s arrest”

The Court of Tirana Judge, Artan Gjermeni, says that the arguments which
convinced him to find Fullani not guilty are that his actions do not
fall into the elements that make power abuse valid. The Prosecution said
they will challenge this verdict at the Court of Appeal.

The Judge says that regarding the Prosecution’s accusation that the Governor has not proposed someone as his vice Governor, the law says that he is elected and appointed by the Supervisory Council of the Bank and no law has set any deadline, especially when his duties are fulfilled by the First Deputy Governor. The Court says his absence has not caused problems with the work of the Bank of Albania.

For the second accusation, for not proposing legal initiatives, the Judge says this is a right of the Supervisory Council too, and it cannot be considered that Fullani was against the law. The Court notes that the Prosecution has not been able to identify Fullani’s violation.

As for the purchase of Dajti Hotel, the court argues that Fullani’s actions have not caused damage to the government, since the property has not been damaged. The value for the purchase of former Dajti Hotel is not a damage, as long as it remains a real estate owned by the state.
