Justice reform, Venice Commission approves preliminary draft

The opinion of the Venice experts is based on the need for justice
reform, but leaves Albanians with enough time until January to find
solution to the concerns raised in this document.

The concerns are related mainly to the organization of new institutions that create problems with the control of judges and prosecutors. They raise questions on how judges are appointed and what guarantees they have during the testing.

The Venice Commission supports the reformation of the High Council of Justice and the Council of Prosecution, but says that the presence of the Justice Ministry everywhere is still concerning.

The draft also notes puts in question the proposition for interrupting the mandate of the Prosecution General and asks Albanian experts to decide about the type of independence for the Prosecutor General, and if there will be decentralization, or if the government foresees only independence.

The opinion of the Venice Commission leaves the problems open, without a final solution which will have to be found by Albanian experts.

The Venice experts will arrive in January to discuss with the experts of both parties and help the Special Commission prepare the final draft with the justice reform package.
